TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the Tape Eater mobile application and related services (the "Service"), operated by MixtapeMonkey, LLC ("MixtapeMonkey," "we," "our," or "us").

By creating an account, uploading content, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the Service. If you are under the age of majority, you must have permission from a parent or legal guardian.

2. User Accounts

You are responsible for maintaining the security of your account and for all activity that occurs under your account.

You agree to provide accurate information and keep your account information current.

3. User Content

The Service allows users to upload, store, publish, stream, and share music, audio recordings, artwork, images, descriptions, and other content ("User Content").

You retain ownership of your User Content.

By uploading User Content, you grant MixtapeMonkey, LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, distribute, and make your User Content available solely for the purpose of operating, improving, promoting, and providing the Service.

You may remove your User Content at any time, subject to reasonable backup, caching, and legal retention requirements.

4. Your Responsibilities

You represent and warrant that:

  • You own or control all rights necessary to upload and share your User Content.
  • Your uploads do not infringe copyrights, trademarks, publicity rights, privacy rights, or other intellectual property rights.
  • You have obtained all required licenses, permissions, and consents.
  • Your content complies with all applicable laws.

You are solely responsible for everything you upload, publish, or share through the Service.

5. Prohibited Content

You agree not to upload or distribute content that:

  • Infringes another person's copyright or intellectual property.
  • Contains unauthorized samples or recordings.
  • Is fraudulent or deceptive.
  • Is defamatory or unlawful.
  • Contains malware or harmful code.
  • Promotes illegal activity.
  • Violates another person's rights.
  • Contains obscene or sexually explicit material prohibited by applicable law.
  • Harasses, threatens, or abuses others.

6. Copyright Policy

MixtapeMonkey, LLC respects intellectual property rights.

If you believe content on the Service infringes your copyright, you may submit a copyright complaint that identifies:

  • the copyrighted work;
  • the allegedly infringing material;
  • your contact information;
  • a statement that you have a good-faith belief the use is unauthorized; and
  • a statement, under penalty of perjury, that the information provided is accurate.

We may remove allegedly infringing material while we investigate.

Repeat copyright infringers may have their accounts suspended or permanently terminated.

7. Content Moderation

Tape Eater primarily responds to user reports regarding content that may violate these Terms.

We are not obligated to monitor all uploads and do not pre-screen or approve User Content before it is published.

We reserve the right, but not the obligation, to remove, restrict, or disable access to any content or account at our sole discretion, including when we believe it violates these Terms, applicable law, or may expose users or MixtapeMonkey, LLC to legal liability.

8. Public and Private Sharing

Users may choose to share content publicly or privately through features provided by the Service.

Even content shared privately may be accessed by recipients chosen by the user.

Users are solely responsible for selecting the appropriate sharing settings.

9. No Responsibility for User Content

User Content is created and uploaded solely by users.

MixtapeMonkey, LLC does not endorse, verify, guarantee, or assume responsibility for any User Content.

We are not responsible for the accuracy, legality, quality, safety, or ownership of any material uploaded by users.

Any disputes regarding uploaded content are solely between the parties involved.

10. Reporting Violations

Users may report content they believe violates these Terms or applicable law.

We may investigate reports and take action we determine appropriate, including removal of content or suspension of accounts.

11. Termination

We may suspend or terminate accounts at any time for violations of these Terms or to protect the Service, other users, or MixtapeMonkey, LLC.

Users may stop using the Service at any time.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, MixtapeMonkey, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

We do not guarantee that the Service will always be secure, error-free, or continuously available.

13. Limitation of Liability

To the fullest extent permitted by law, MixtapeMonkey, LLC, its owners, employees, contractors, affiliates, and licensors shall not be liable for:

  • User-generated content;
  • copyright or trademark infringement by users;
  • lost profits or data;
  • indirect, incidental, consequential, special, exemplary, or punitive damages;
  • damages arising from the use or inability to use the Service.

Our total liability for any claim shall not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid to use the Service during the preceding twelve months.

14. Indemnification

You agree to defend, indemnify, and hold harmless MixtapeMonkey, LLC, its owners, officers, employees, contractors, affiliates, and agents from any claims, lawsuits, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • your User Content;
  • your use of the Service;
  • your violation of these Terms; or
  • your infringement of another person's rights.

15. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time without liability.

16. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed under the laws of the State of Missouri, United States, without regard to conflict of law principles.

Any legal action shall be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction.

19. Entire Agreement

These Terms constitute the entire agreement between you and MixtapeMonkey, LLC regarding the Service and supersede any prior agreements relating to the Service.
